Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Brane ("Brane," "we," "us," "our"), our brand-identity generation tool. By accessing or using Brane, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. Using Brane

Brane lets you submit a brief describing your business and generates a brand identity system in response, which may include strategy notes, color palettes, typography choices, and guideline documents. You may use Brane only for lawful purposes and in accordance with these Terms.

2. Eligibility & Accounts

You must be at least 16 years old to use Brane. If you create an account, you're responsible for keeping your login details secure and for all activity that happens under your account. Let us know right away if you suspect unauthorized use.

3. Acceptable Use

When using Brane, you agree not to:

• Submit briefs or content that are unlawful, infringing, defamatory, or that you don't have the rights to use.
• Attempt to disrupt, overload, or gain unauthorized access to Brane's systems.
• Use the service to generate brand identities for the purpose of impersonating another business or individual, or to infringe a third party's trademark rights.
• Reverse engineer, scrape, or resell access to Brane without our written permission.

4. Your Content

You retain ownership of the brief content, prompts, and other material you submit to Brane. By submitting it, you grant us a limited license to use that content solely to generate your output and operate the service. You're responsible for making sure you have the rights to anything you submit.

5. Generated Output & Ownership

Subject to your compliance with these Terms, you own the brand identity output Brane generates for your brief, and you're free to use it for your business. We make no guarantee that a generated output is unique or free of conflict with existing marks — you're responsible for clearing any name, logo, or trademark you intend to use commercially, including through your own trademark search or legal counsel.

6. Third-Party & AI Processing

Brane relies on third-party infrastructure, including AI processing providers, to generate output and operate the application. Your use of Brane is also subject to the acceptable-use policies of those underlying providers, and we're not responsible for outages or limitations originating from them.

7. Fees

Some features of Brane may be offered free of charge, while others may require payment now or in the future. If paid plans are introduced, pricing and billing terms will be presented to you before you're charged, and continued use of any paid feature means you agree to those terms.

8. Disclaimers

Brane is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee that generated output will be error-free, uninterrupted, or suitable for any specific commercial or legal purpose.

9. Limitation of Liability

To the fullest extent permitted by law, Brane and its team won't be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the service, including reliance on generated brand output for business or trademark decisions.

10. Termination

We may suspend or terminate your access to Brane at any time if we reasonably believe you've violated these Terms. You may stop using Brane and, if you have an account, request its deletion at any time.

11. Governing Law

These Terms are governed by applicable laws in the jurisdiction where Brane operates, without regard to conflict-of-law principles, unless a different law is required to apply to you by mandatory consumer-protection rules.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes to Brane or for legal reasons. Continued use of Brane after changes are posted means you accept the updated Terms.
